By accessing or using ThumbGlot (the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service. We reserve the right to modify these Terms at any time, and your continued use of the Service constitutes acceptance of any changes.
ThumbGlot provides AI-powered YouTube thumbnail translation and generation services. Users can upload thumbnail images, analyze text content, translate text into multiple languages, and generate new thumbnail images with translated text. The Service operates on a subscription-based credit system.
You must sign in using a valid Google account to access the Service. You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. You must notify us immediately of any unauthorized use of your account.
The Service offers paid subscription plans with monthly billing cycles. By subscribing, you authorize us to charge your payment method on a recurring basis. Subscription fees are non-refundable. You may cancel your subscription at any time, and cancellation will take effect at the end of the current billing period.
Each subscription plan includes a monthly allocation of generation credits. Credits are consumed when generating translated thumbnails. Unused credits do not roll over to the next billing cycle. Credit costs vary by output resolution (1K, 2K, 4K). We reserve the right to adjust credit allocations and costs with reasonable notice.
All payments are final and non-refundable. Due to the nature of our Service, each generation consumes upstream AI infrastructure and compute costs that are incurred immediately and cannot be reversed. This includes subscription fees, add-on purchases, and any credits consumed. By subscribing, you acknowledge and agree to this no-refund policy. We recommend starting with the Starter plan to evaluate the Service before upgrading.
You retain ownership of all images and content you upload to the Service ("User Content"). By uploading User Content, you grant us a limited, non-exclusive license to process, analyze, and modify the content solely for the purpose of providing the Service. You represent and warrant that you have the right to upload and use any content you submit, and that your use of the Service does not infringe on any third party's rights.

The Service, including its design, features, code, and branding, is owned by ThumbGlot and protected by intellectual property laws. You may not copy, modify, or distribute any part of the Service without our prior written consent. Generated thumbnails are derivative works of your original content and are licensed to you for your use.
We strive to maintain high availability but do not guarantee uninterrupted access to the Service. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We are not liable for any damages resulting from service interruptions or downtime.
To the maximum extent permitted by law, ThumbGlot and its operators shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, or business opportunities, arising out of or related to your use of the Service. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.
The Service is provided "as is" and "as available" without warranties of any kind, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that generated thumbnails will be error-free, that translations will be perfectly accurate, or that the Service will meet your specific requirements.
We reserve the right to suspend or terminate your access to the Service at any time, with or without cause, and with or without notice. Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination will survive, including ownership, warranty disclaimers, and limitations of liability.
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which ThumbGlot operates, without regard to conflict of law principles. Any disputes arising from these Terms or the Service shall be resolved in the courts of that jurisdiction.
